 Expert witness role

The duty of a General Practitioner expert witness is to the Court. A GP expert witness provides an impartial medical opinion to the Court, tribunal or committee and provides a medical opinion on the facts of the case. This is different from the role of the professional witness.

GP expert witness responsibilities

When instructing a GP expert witness, Solicitors will usually look for experts who:

  • Have the relevant practical experience in their area of expertise
  • Are able to produce concise and comprehensive GP medical legal reports
  • Are impartial
  • Have a medico legal practice and sufficient time to deal with the case
  • Will attend Court to give evidence if required

Expert witnesses are instructed by a party, such as a medical reporting agency (MRO), by an insurer or a solicitor, to provide their medico legal opinion and specialist knowledge on issues or facts, to help resolve a dispute on a in a medico legal matter.

An GP expert witness will not have been personally involved with case that they are providing evidence and opinion on (written or oral) and they are providing General Practitioner evidence because of their specialised knowledge of a specific field relevant to the case.

A General Practitioner expert witness is usually instructed by one party, or sometimes both parties in a dispute, known as a single or joint expert instruction. The duty of a GP expert witness is to assist the court with the outcome of a dispute by providing an independent GP medico legal report which is unbiased.
